First of all, thanks to Jacob Coakley at Stage Directions magazine for the editor’s note that mentioned my Chicken of the VNC post – and more importantly the idea that sharing our skills and acquired knowledge is a worthwhile endeavor for us all. So Context. As in: the context that we operate from when we create artistic work or artistic commentary. And the context of others, and the context of others and the context of others. Thank you, THANK you, gentlemen, for sharing your context.

It is so helpful and enlightening to understand the background of an artist. Half the show for me is leafing through the program and remembering the last show or conversation I had with an artist and understanding the work that I see in the terms of what they’re working on and exploring now. Because of this habit, I’m a true fan in the Long Tail sense of the word of many actors and designers in Chicago, and I’ve caught some moments that I’ve carried as utterly magical that I think most audience members don’t normally appreciate – because they’re moments of improvised learning. By understanding the background of an artist, you can catch the moments when the artist suddenly “gets it,” and pushes past their previous limits. I don’t really enjoy divorcing the work from the artist. That feels like amputation to me.

I had a great first face-to-face conversation with Paul Rekk at the Jeffs last night, which I hope was helpful for both of us. His post a few days ago helped clarify for me the reasons for our divergence of perspective – we come from radically different backgrounds.

I grew up in Amherst, Massachusetts. The status quo there – the one I felt compelled to rebel against as a teenager – was one of alternating impotent liberal wishful thinking and cutting 90′s progressive cynicism. Amherst, in case you’ve never heard of it, is famous for its five colleges in close proximity that you may have sensed recently in the shadows of Scooby Doo reruns, its horribly authentic yet utterly disconnected Belle, and the unfortunate human rights record of its namesake, the Honorable Lord Jeffrey. Most alarming to my adolescent brain was that most of the folks in this extremely politically active town ignored the basic precept of fellow Masshole Tip O’Neill: “All politics is local.”

In Amherst, all politics is International. The town is overrun by politically astute 18 – 24 year olds all running away from the demands of their families for the first time in their lives – and the professors and administrators that make a comfortable living off them. The local community might as well not exist as far as the colleges are concerned. I grew up a townie in a school filled with the sons and daughters of professors – which means I was on the empty pockets side of intellectual gentrification. I wrote my early plays about the old men in greasy spoon diners, trading the real wisdom of the world as the world sped up around them. The encroaching property taxes that made retirees leave their hometown after decades even went to prop up that old museum piece of New England democracy – our “functioning” public town meeting that ‘led’ our town through a process that resembled permanent filibuster, while the real power was held by a permanently appointed Town Manager. Imagine a City Mayor appointed for life! Oh wait… And most folks my age were too busy making a show of rejecting the idea of establishment and re-rejecting the disestablishment. So they’re all far too busy to engage with the actual establishment – they wanted nothing to do with local reform or local community. They would rather buy the Che Guevara t-shirts if you know what I mean.

And so of course I ran from my community in the end. I moved to Dallas and saw the most well-SUV’d part of Texas mobilize for the War on Terror by purchasing ever larger and more reckless tanks of gasoline while embracing a skin-deep caricature of patriotism. I watched my family with my electric binoculars fight to stay united, grow up, and not lose their homes to the social will of my hometown. And I found another family, an urban family, and a place where I felt useful. And that’s when I stopped my adolescent self-pity in the face of my own terror and self-recognition, and saw the poison I drank in each lost connection.

This is my context: I sense a deep hypocrisy in the cynicsm of willful disconnection and disassociation with those connections that exist between us. I deeply value progress, but the advocates of progress became in the nineties an incredulous kind of lazy and entitled. And then we saw the consequences of that half-assed progressivism – as part of the country claimed we never had any values at all and took over, running our values into the mud.

I think that’s turning around now, but we’re kidding ourselves if we think our generation isn’t going to face an onslaught of responsibility now that we’re taking over the wheel, institution by institution. I feel a call to service these days – to not repeat the mistakes of the village that raised me and taught me – how they forgot their roots and their neighbors in their push for progress – while also upholding the values of that village in the face of eroding American values and eroding American justice that we all feel. When I first moved to Chicago, I think I wanted to escape from the erosion of the places of my past – but even here, I don’t feel safe from eroding values and eroding justice. I don’t feel safe from complicity in the many injustices of this country and this world simply because I’m in a place where people share my values.

We’ve all felt that kind of powerlessness in our lives – the question of “why do this at all? I’m not arguing a legal case that will affect a life. I’m not fighting hunger or disease or poverty. I’m not relieving disaster victims.” Well, to disengage from that responsibility simply because we are powerless to fix large social problems as individuals is not a valid solution to me. In my context, the way to make an impact on the world is to practice connection. It is to practice and value detail in craft, to create quality in all our lives. This practice fights that sensation of powerlessness in a human-sized way, to create a real, vital community through our collective creative work and our ability to listen to each other. Communities are built individual by individual, and piece by piece – and it’s communities that have the ability to create change.

Death, decay, and destruction take care of themselves. Growth requires food, water, and a big bright light shining on it. In my context, if you’re not re-building, you’re damaging.

In my context, you can choose to create and support the craft of your peers and neighbors on a sustainable scale, or you can tear down and destroy – models, ideas, and work – and leave an empty shell of a wasteland. That’s not a clean slate as far as I’m concerned… It’s a world where positive energy was stopped and paved over by negative energy into a place where it couldn’t grow anymore.

And is the crux of some of our online arguments, no? In other contexts, harsh criticism is valued as pure truth. It’s valued that way because the folks who have that perspective have been witness to comfortable lies for too long. They see how cooperative initiatives can be co-opted by self-promotion, the PR game, and profit. In their context, the ultimate sin is self-censorship and watered-down art in the name of decorum.

I know that this hope for community and mutual support – not dishonesty, support – comes off as wishful thinking in our context-less world of the internet. Here in Chicago, where my Yankee roots don’t share a lot of the same background as the midwesterners who have had to tear down some actual injustice and external ignorant destructive forces to get to play in this White City, my all-for-one-and-one-for-all message comes up against some legitimately divergent viewpoints. Which is fair, and I’m eager to learn to be at better peace with it.

My context informs my work: The theater I have chosen to call my home has a very clear mission that speaks to these beliefs: we “create intimate, animate theatrical experiences which renew both artist and audience.” I also consider teaching and opening doors for younger artists or artists without my experience to be a cornerstone of my life’s work. Teaching for me isn’t about giving the right answer, it’s about asking the right question. It is about testing ideas, but also understanding them, supporting them and letting them thrive on their own terms.

So deliberation in the theatrosphere is not about finding the penultimate truth for me, because I don’t believe in those lofty ideas on a hill. I believe in perspective. I believe in seeing each other’s work, and seeing each other work. I believe in growing within and embracing our own context.

All politics is local.

Connecting with the Audience

Two experiments that can help us understand how big this task really is:

1.) Internationally reknowned playboy and violin virtuoso Joshua Bell played a trick on commuters with the Washington Post. He dressed in clothes that might be described as Wrigleyville chic and played six challenging and downright magical classical pieces “like a God” on a multi-million dollar Stradivari – all this across from an Au Bon Pain.

Only a few brave souls so much as slowed to listen, and there was uncomfortable shuffling in lieu of applause. (natch)

2.) Building Stage is developing their next production, Master Builder, publicly on their blog. The goal:

We really wanted to use the blog as part of our process, something that was integral to the creation of the work, as well as a tool for opening up our process to our growing family (company members, collaborators, audience) to witness, comment on, and influence.

After starting two weeks ago, the production team has 10 posts on a broad range of production topics, including Sound Design, Props shopping, costumes, themes and directorial concept, and of course, marketing. Comments so far from folks uninvolved with the project: 1 – an interior decorator. (that’s a good start for two weeks on a blog, no?)

We’ve been chatting at New Leaf about audience experience for a while and what we’d ideally like an audience member to take away from each experience with us and our work. Over the years we’ve cooked up a number of different methods for teasing those experiences out of them. In marketing speak, this has been about changing the positioning for our theater – getting our audience to shake up their expectations of a storefront theater by experiencing us in different and unexpected contexts – at work on our blog, on their iPods – and also about integrating each world of play into a greater “world of the company” via our mission.

Theaters actually experiment with the audience/artist relationship a lot in the hopes of drumming up new interest – but the audience is uncomfortable with unexpected contexts for our work, and often gets confused, scared off, or dismissive of innovative tactics. Audiences are smart, and they are universally agile when it comes to protecting their time and interest from the possibility of public performance by disengaging from a pitch, request, or an uninvited interaction in under 15 seconds. That’s the amount of time you have to close the deal, so if you spend it trying to close the deal, you’ve already lost.

The calculated smell of popcorn works wonders for movie theaters, for example…

This all leads me to think that saying that we “experiment” with audience interaction isn’t really accurate – this ain’t no lab we’re running. We downright gamble with pet ideas that we think will work, and are usually less than scientific about using data and controls alongside with real innovation. If we somehow learned the discipline of statistics and combined it carefully with our street performer instincts that can reengage a wary patron, we might actually take away firm knowledge and show the world something it hasn’t seen before. That ultimately means change that is slower than theaters want, but faster than marketing professionals, boards, and other suits think is possible.

I think we can all agree: it’s nice to have that great music shared on the way to work, isn’t it? Maybe that should be a more regular part of our lives.

Where to find the Good Stuff

Way to go, Chris, Kris, and Tony. For those of you that haven’t read the web-only companion article to this week’s “side of Lance Baker” on the cover of TimeOut Chicago this week on making it as an actor, it’s a nice little piece on the central question on what seems like everyone’s mind as the NEA is flushed and the government gets out out of the philanthropy business – Do we deserve to get paid for this work? And even if so, who should make it a priority to do the paying – the audience, the society, or ourselves? As much as I’d love to lament the alarming reduction in local, state and federal funding for the arts, it’s becoming more and more apparent that it’s time to solve the problem of funding our work on our own. Grants are drying up due to some pretty hostile mismanagement – social sabotage, really – on the state and federal levels of government. When the tide turns back for government funding of social projects (and it will), I think we can all agree that poverty, funding for health care, relief work, and education – all of which are equally being shafted now – should be bigger social priorities than the arts. The arts need to thrive just the same, though – and that means a certain level of inventive thriftiness with our time and money.

It all gets demoralizing, though. I’m teaching some middle schoolers this week and we’re doing – of all things – a play called “30 reasons not to be in a play.” It’s unfortunately not all that ironic a title. Being in the play means rehearsal, and focus from the cast of 30 and tech crew of 8 while in a dark cafeteria watching other kids play outside in gorgeous weather. It means convincing often incredibly inflexible parents to cancel any number of poorly-scheduled piano lessons and dance lessons and baseball and soccer and errands. How can a seventh grader ask their parents to prioritize a school play when the parents don’t value the experience? It means remembering lines and overcoming awkwardness and shame to find… more awkwardness and shame and the very occasional moment of inspiration. It means being in the wrong place and not knowing what you’re doing… and doing that with absolute confidence. It means not texting your friends or checking your facebook account for nearly two hours most afternoons.

Between the parents and the teachers’ scheduling conflicts and the priorities and the dwindling resources of the school, it’s not surprising that children of this age are in a constant state of freakout. The kids are in an ideological warzone – I guess I was too, back at that age – and they haven’t been equipped to navigate it. This is why real change takes generations, not years. These kids are developing in a time of radical and chaotic change, and that will have as many crazy effects on them as the sixties had on the baby boomers.

I thought I was going to have more to say about the Europe / America contrast, but the middle school experience has boiled all of that exploration and soul searching to a central zit-on-the-nose problem: I am an American, and like many Americans, I don’t regularly practice the enjoyment of life. You know, really savoring it. I think I have it, and I pursue that enjoyment, but then life becomes about the pursuit of a bigger happiness, not the happiness we already have available to us: Walking. Eating. Sleeping. Playing. American lives are built to limit, compartmentalize, and focus the time we spend doing these things – in the name of pursuing more time and resources to enjoy these things securely. We teach our children to constantly pursue a bigger better tomorrow and we pack their lives with enriching activities when it’s really the today that needs to be improved and enjoyed. It’s just a backwards logic, and I’ve noticed it in myself rather alarmingly. I always need to walk a bit faster, eat a bit faster, and experience more and more, to the point where I’m not really experiencing anything but panic, anxiety and adrenaline. In theater, I find that human pace again, the easy heartbeat.

Maybe all this aggressive model-building and value-hunting for the future of our theater just feeds the wrong beast, and the secret to creating a new, vital theatrical audience is to follow the lead of a group like the The Heart of Gold. I think I’ve mentioned the HoG here before, and I certainly have over on the New Leaf blog: it’s a Chicago arts commune with weekly performances and quite literally a HIVE of artists and fans that come back weekly for art of all shapes and sizes. Artist and audience mix here – one night you’ll put up your work in the gallery, the next night you’ll see what your friends are doing with that puppet show. Oh, and they throw a lot of potlucks. It’s not a crowd growing like wildfire – it’s more insular and low-profile, with a small audience that grows slowly, person by person. But the people that go become regulars, thus supporting the art over the long term.

What’s the message for this new audience? Kick the Hell back, and enjoy being IN the entertainment. Enjoy the interaction, and make it a vital part of your life – for the benefit of your life. The default response to viewing a show isn’t necessarily crossing your damn arms and sitting in judgement. And there, it’s understood that art doesn’t get finished, it just gets shown again. That means we can’t be satisfied when art feels lazy and doesn’t get to the heart of the matter – but we can enjoy the process getting there. “Theater isn’t a very reliable entertainment” – my eye. That’s the wrong approach – it’s the wrong framework to view how to build a new audience. Audience members who want “reliable” entertainment will go for prescription drugs. Television is only reliable because it is carefully checked and vetted for flavor consistency, you know, like Folgers. Film increasingly attacks all the senses like a carbonated seizure. Film doesn’t work at the pace and volume of life anymore – films told at a life-like pace become low-viewership art house and independent flicks. Storefront theater is locally grown, and sometimes that means you taste a little grit, but the real revelation is in how you feel when you’ve developed a taste for the freshest stuff. You feel connected to your life again.

Theater should be sold like good food: you savor it, you discover it, and then you reflect in appreciation and conversation when the plate is empty. It’s an active experience, and it doesn’t always taste the same. Sometimes a bitter or sour taste brings out the sweetness. It demands your intelligence and an open heart, and I’d say an appreciation if not acquaintance with your local farmer / artisan. The kids get this – they’ve started bringing their parents in, helping put up pieces of the set and putting work into the play. It’s a little Waiting for Guffman, sure, but the parents become instant converts when they can participate that fully in the hobby of their child, and the child starts leading them through what needs to be done. In many ways, theater as we move forward isn’t about the play at all – It’s about the ensemble. We remember specific meals, perhaps, but we keep coming back to experience the work of good cooks.

Best of all, when global food prices shoot through the roof and throw the third world into devastating food shortages, locally-grown food is becoming a worthwhile growth market again. Through locally-grown theater we teach ourselves to interact positively with emotions, subjects, and ideas we don’t understand that are right in our back yard – ideas that are held dear by others in our community. And as Americans moving towards a hazardous political and social future, we need to be much more sensitive and adept at just that.

Wow. Been talking with way too many 12 year olds. You guys know what I’m talking about.

Well Shucks

It looks like I wasn’t the only stone that skipped across the pond. I probably missed this in the pre-trip slam, but that good ol’ value blogathon had a good kerplunk on the Noises Off column on the Guardian blog a few weeks ago – including a quote from yours truly. It made me feel almost relevant after sadly pouring over the delicious offerings in this year’s Festival over in the Hub at Edinburgh last week – half impotent and half relieved that I wasn’t able to sample any local theatrical delights this time around. Just the food and whisky, Dank u vel.

And god help me, I think as I get back to the grind I may have to write one of those insufferable pieces comparing Europe with America. I know, I know. But the contrast has been useful to help see outside perspective with more clarity – and Don’s piece on poverty and my conversations with our B&B host in Brugge about the European approach to poverty and the ongoing – and accelerating? – segregation of American society has got me thinking about theater that can be vital to our own community again…

I’m not one of those folks that thinks that Europe has it right. I could move to Sweden if I thought that. Or maybe just shack up at Ikea Schaumburg. No, the European system that works quite efficiently enough, thank you, is the result of centuries of city planning in the form of genocides, population clearances, religious wars, and other aggregated forms of culture assassination. We’ve only got SIX centuries of THAT to our credit, so if we keep following that path – as we are as we emerge as a fairly callous and self-interested empire – we’ll ALWAYS find ourselves behind that eight ball. We need to do what we were best at during our darkest hours – smart-aleck innovation that changes the game of injustice and lack of resources. Just because our hours here on home turf haven’t been that dark in some time doesn’t mean that innovation isn’t needed.

As luck would have it, I had plenty of time to think today about what seeing Europe as an outsider has taught me about my Americanness. Because after getting on the blue line at O’Hare – with a sigh of relief of familiar ground that didn’t require translation – and traveling oh, thirty minutes to Rosemont station, the friendly CTA that just sold our dutch travel buddies their $20 universal day pass – a bargain! – had us all get on a bus to take us two stops forward past slow zone construction, then back on the train. After being whisked across the otherwise desolate and unpopulated Scottish countryside in a smooth-as-butter rail journey, the welcome our fair white city currently gives to our international guests is, well… let’s hope it gets fixed for the Olympics or we’ll have some ‘splainin’ to do. And if we don’t have the Olympics to serve as sufficient impetus for a worthwhile public works initiative, what do you think – will our own community’s well-being and happiness be enough? Ha ha.

But enough smart aleck-ness from me. It’s good to be home after a wonderful trip, jet lag and all.

The Business of Changing People’s Lives

I normally feel eeeeeeecky after cross-posting something I wrote elsewhere, but around the time when we were revving up for the ol’ value blogathon last week, I wrote a draft at the New Leaf Blog that ended up really summing up a great deal of big and small thoughts I had about Tony’s Critiquing the critics project, the complex dynamics of an experiment that isn’t an experiment theater-as-tribe lab at New Leaf while producing a show that we both love and has received mixed reviews, and what it takes to draw success from a work that few people frankly end up seeing.

I guess what I’m trying to say is that the post had some resonance with the structural issues of theater I’ve been talking about here, and it’s a hard-and-fast example of why theater is valuable to both artist and audience, and also why that value is usually hidden. It was kind of a personal exploration of where the company and where the show is at right now, mid-run, so I didn’t end up publishing it until tonight, but you can read it in its entirety here. It was a biggy for me.

Here’s an excerpt, enjoy:

It’s always a shock to the system when you live through the same events as someone else and as you look back, they somehow have a completely different experience than your own.

The most difficult and scary part about producing theater – especially newer works – is that we have almost no means of controlling the exact narrative the audience walks away with – we have the collaborative process, and the clarity that (sometimes) comes with a well-defined artistic concept. With classics, there’s often decades or hundreds of years of established narrative that focuses attention on your specific production. In recorded and published media, the audience is allowed to go back, and reexamine, and in some cases find the “correct” interpretation intended by the artist. In theater, there are no second chances to re-examine and realign the audience’s experience. The story that played out in the audience’s head and heart, inspired by the events and actions you put on stage, is the story that actually happened. Of course we’re all living through the same events, but in some cases, we as artists don’t often get the feedback of finding out what that exact story was.

We’ve been talking on the [New Leaf] blog how we, as individuals, remember the last moment of our childhood, and in an odd, circuitous way, that ongoing narrative has become something equally momentous – I think that Goldfish Bowl marks the end of New Leaf’s childhood as a company. The emerging narrative from our string of reviews is that Goldfish Bowl is an intelligent and at the same time confusing play. We’ve been recognized in these reviews for consistently producing challenging work well, and taken to task for not drawing focus to elements of the play that we’ve found less vital to our mission as a company.

In many ways, this critical narrative doesn’t jive with how we see ourselves (tale as old as time, right?), and yet it’s the narrative that we must now move forward with through the rest of the run. Now it’s the narrative that our audience may be bringing with them as they walk in the theater, and it’s a narrative we are unable to address now that rehearsals are long over. A young theater company will complain when someone doesn’t “get” the play, because they don’t fully realize how important the audience’s given narrative is. An older theater company realizes that the purpose of a show isn’t simply about getting an audience to ‘accurately’ interpret your production – it’s about resonance, those moments that stick with you for much longer than the two hours you sit in the theater. It’s about tricking moments of clarity and self-reflection out of your audience, even if those moments are wildly unrelated to the show. It’s about providing an ideal setting for reflection, and sometimes that setting requires stepping back and not over-conceptualizing a script. That reflection is the gold that we’re mining for in this work – it is the mechanism of renewal.

Jared [Moore, Lighting Designer]‘s comments clarified my own feelings on the subject: You have to let the narrative happen. The audience’s ability – your ability – to form your own narrative over and through our story is what allows you as a member of the audience to have ownership of our work. It makes the audience part of the creative team, and in many ways the audience has always been the most fundamental part of the creative team. That’s what makes theater different. Audiences may rarely understand the specifics of what I had in mind when I create a design, but that doesn’t have to be a discouraging thing — because what they do find is something that they had lost and they need again – a memory, an emotion, a moment unlocked and treasured.We cannot control how other people see our work, and yes, that’s often frustrating, and to be candid, a source of fear and trepidation. But without that dichotomy of interpretation, there’s no surprise, doubt, disagreement, and reconnection. There’s no dialogue between artist and audience, and no conversation as you walk home from the theater. As we often say at New Leaf – those are the moments where a great theater company gets you hooked.

Richard Christiansen Sees the Future in a Museum

And when he speaks up, I for one listen:

Individual organizations attack these problems as best they can. But progress on a larger scale is necessary, and great projects, such as Millennium Park, need resources that no individual organization can offer. They need the involvement of an extraordinary coalition of private and public interests.

It’s not enough to acknowledge that the performing arts are a vital part of city life; that has become a civic mantra. We need to formally celebrate them, as other cities have, as a major part of our history and a source of Chicago’s worldwide acclaim. This is not a matter of pride or boosterism. It’s a case of further encouraging and energizing the arts in concrete terms, of showcasing theater, music and dance as a central part of our identity. We need something to honor the past, enrich the present and inspire the future. We need, to be specific, a Museum for the Performing Arts.

Now I could think of no better person than him to help curate such a museum, since he’s had an unflinching love for the Chicago theater scene for decades. And I know Patrick’s already collected the photos

Great Expectations

Well, well, it’s a public brouhaha!

It’s not really in the purview of the adrenaline dose that is the TimeOut Chicago exposé to sort out the dust and mud that gets kicked up in the process, so I’m glad that Patrick over at BackstageJobs has already started to explain some more of the background of TOC’s article this week on the Bailiwick’s rosy picture of its own financial woes and those of us who cried foul. This was a conversation that Tony started in response to a a few weeks ago, and has been picking up steam as a story ever since. And don’t read me wrong here – I’m thankful also to Jake Malooley and TOC for doing what they do best – shining the light down in the ugly boiler room of Chicago theater we’d rather forget about and not being afraid to break down a few doors to get down there. I’m just saying now someone’s got to repair the hinges, is all.


What has happened since the initial volley of public venting is a general agreement among several of us mentioned in the article that this kind of issue doesn’t simply exist at the Bailiwick – it’s an industry-wide problem of theaters that are taking advantage of the semi-pro semi-volunteers that work for them. And it’s very rarely a case of the big malicious theater exploiting the unsuspecting artist. It’s more about the consequences of willful ignorance. Most theater managers, Zak included, have the absolute best of intentions and they truly believe they are providing artists with opportunities and reasonable access to the industry. This is a problem of miscommunication leading to unintentional exploitation.

From my own experience, the Bailiwick was one of the first theaters I worked at in town for a single reason: they post jobs constantly, and at the time they came up pretty high on a google search for “Chicago Theater Companies.” That makes them a very appealing theater to someone who doesn’t know the scene and is, as I was, green, green, green. I had a rough, confusing experience there, but I was paid what I was promised. A later production I remain unpaid for, but in the scheme of things I don’t really care about the money, and I won’t be knocking on Zak’s door to collect, ever, thus completing the skip-to-my-loo solution that Zak proposes:

“I wouldn’t be surprised and I wouldn’t be angry,” he says. “If someone says to me, ‘I had a $100 check and I couldn’t cash it,’ I would say, ‘Oh, my God. Let’s go get it cashed. Let’s solve it.’”

One of the reasons I never made a big deal about that particular fee is that I’m largely at fault for not being paid – I never insisted on a contract before performing the work. I was even hired on the Bailiwick’s behalf through another artist, and David and the business manager at the time weren’t even involved in the conversation, and that’s my fault for continuing to work without a written agreement. More experienced theater artists and vendors don’t make this mistake – most of the people I’ve talked with that do business with the Bailiwick and frankly, most theaters, are on a 100% – 50% COD policy with them before work is performed and goods are delivered.

There’s another big reason I’ve never gone collecting – I’ve made that lost dough back in indirect trade. In an industry as poor on cash flow as this, we cannot underestimate the power of trade to solve disputes. I’m no longer angry at Zak, which is one of the things I tried to communicate to TOC before the article came out. I’m glad the conversation happened, but I want to make it clear that this needs to turn into a conversation about best practices for every theater and freelance artist in town, not simply one theater company that has a bad reputation. As Patrick says, bad reputations will come and go. The ANGER came from a very specific and recent incident of not $100 but $3000 that he owed a close friend of mine, putting that friend in serious financial trouble for several months. Since the blog conversation but before the TOC article, David has made amends for that debt. I know that David’s capable of great and honest generosity… one of the things I mentioned to TOC is that David was directly generous to my own theater – the Bailiwick loaned us a dusty and unused lightboard free of charge for several of New Leaf’s productions, including our breakout show The Permanent Way. I don’t know what we would have done without that board for that show, and that was more than worth walking away from a couple productions unpaid.

I don’t relive all this to add fuel to this particular fire – I mention it because one of the ancillary skills that all theaters and freelancers need to get together and develop right away is the ability to write, read and live by contracts for all work done in any theater, before that work is done, and no matter how small the producing company. If we want Chicago Theater to be anything but a well-intentioned golem chewing up emerging artists and young companies in a cycle of missed reimbursements and shabby rental spaces, we all need to get really specific about what we expect from each other, and we need to have a fair and equitable mechanism to hold companies and individuals who don’t follow through on promises accountable. Too often the contract discussion becomes about money, and I think it’s unrealistic to limit agreements to that in theater – it needs to be about all our resources – time, equipment, in-kind donations, space, working conditions – everything we rely on.

We’re all about quickly converting lessons and theory to calls to action on the blogosphere these days, which I think is pretty sweet. Here’s what I’d say is a call to action that can is fair to new theater immigrants and the Bailiwicks of the world and will even the playing field a bit:

1) Insist on a contract for work that you do, even if unpaid. If a company doesn’t give you an agreement, write it for them. Don’t just bitch about your past grievances – write them down in a sample contract and map out things you’re willing to put up with for the art, and things you’re never willing to put up with. Some examples:

  1. I will not put up my own money for show materials and be reimbursed later – if I agree to procure goods to aid the production, I will be provided with funds from the company before the purchase is made.
  2. I will be paid half of my fee no later than a week before opening, and the remainder of the fee at strike
  3. I will be provided a safe place to store my valuables
  4. I will not be expected to go up on a ladder
  5. Tech week notes will be given to me in a timely fashion – no later than 12 hours before they are expected to be implemented in the production
  6. Company is responsible for equipment or property donated in-kind to the production run, and will be liable for $XXX replacement cost in the event of theft or damage.

You know, whatever it is you need to do your work safely and happily. It’s your contract. You decide what goes in.

Some clauses may not fly in any given agreement – but both parties will know what to expect from each other, and disputes will be more easily resolved, because they’ll be resolved calmly before the pressure is on. That’s the beauty of a friendly and simple legal document.

If a company or individual isn’t willing to draw up a simple one-page contract, or if they find it unnecessary – that’s your first sign right there that maybe they won’t be willing to follow through on other promises they make to you, like paying you – or paying you back.

normal_fgw_337.jpg2) Under no circumstances should you rent space from a company without first reviewing a contract, inventory of provided equipment and services. I actually think that boilerplate agreements for all rental spaces in Chicago should be transparent enough to go right on the public League of Chicago Theaters Wiki, allowing theater companies a clear comparison of what renting each space entails. Aside from the dough involved, these agreements should include clauses regarding:

  1. Hours of Operation, AND all hours available to a rental company
  2. Noise levels permitted
  3. Dressing Room square footage and conditions
  4. Box office services or space provided
  5. Lighting & Sound Inventory in working order
  6. Heating & Cooling regulations
  7. Trash removal

3) Both of these kinds of agreements taken together can accomplish something kind of extraordinary for a small theater – taken together, they quantify the costs, time, and human resources required to produce a show. As any grant writer will tell you, that’s a difficult number to pin down and it’s invaluable when justifying more funding for your theater. Letters of agreement provide a buffer of understanding and that can pay off in load in and tech week. Too many small companies will try to shoot the moon and go into a production without knowing exactly who will staff the box office or who will take out the trash. That’s the kind of oversight that will make your artistic team really cranky, and that’s not good for the art.

4) You’re not going to get it right the first time, that’s why contract negotiation is a skill and not something you cut and paste off the internet. Give yourself some time for a nice healthy post-mort after every show you do, and work the conflicts and the confusion into your next contract. I keep a word document on my computer, and I’ll just add a line when a behavior becomes unacceptable to me. I’m getting to the point where I’m going to add “Sound Designer will be provided with a simple and stable tech table in the space for load in and tech,” because I have an array of computers and hard drives that will get damaged if they’re sitting between the seats. Or, maybe I’ll just suck it up and get over it… and buy a table myself that I take with me (Tax write off, anyone?). Either way, I’m working happier, my equipment is less likely to be damaged and I’ve taken the responsibility I’m comfortable with taking for my own working conditions. I’ve made it easy on the theater that I’m working with, but that also means I’m more likely to get aggressive if they renege on paying me on time. Patrick’s example for being aggressive with a delinquent company is perfect:

3 different lighting designers tell me of the show they worked on where the paycheck never came. They continued to design and program the show with the promise that the check would be there at first preview, then at third preview, and then “definitely at opening.” These three designers, each designing at different theatres on different shows for different companies at different times, all arrived at their theatres early, saved the show(s) to disk, pulled the disk out, and ERASED THE SHOW FROM THE LIGHTING BOARD. They then waited until the SM or PM arrived to inform them that there would be no lighting for the show until they had a check in their hand. In at least 2 cases, they were the only ones to get a check that night (though others had been given the same promises runaround).

You can’t just pull this kind of behavior off and expect to keep your reputation for being a team player. You need to be crystal clear with those that you work with from the moment you begin a job: This is how you can work with me to develop a happy and mutually beneficial relationship, and this is what you can do that will make me go nuclear and take away your ability to produce the show you want. If you don’t have that legal foundation when you want and/or need to go nuclear, you’re up a creek. If you have the legal foundation, however… well, when the TOC exposé is written about it later you can pull out your contract and your notes of exactly how the producing company acted in bad faith.

I know reading and writing contracts makes most of our eyes cross, or even worse, saddens us because it injects a certain amount of litigious behavior into the art. But I don’t think that sadness gets us off the hook – if we throw up our hands and refuse to do it in the name of simplicity or faith in humanity we get only what we deserve – unaccountable rental houses and theater companies that have an unforgivable habit of running us over in defense of their own survival. I think we’d all rather take the time to write a one-page contract and update it from time to time than risk trusting someone we shouldn’t that they’ll pay us back for all that lumber and winding up $3000 in debt with no freaking recourse. And, if more of us who do act in good faith work to protect that good faith, we can all breathe a little easier in the future.

And the streets will be made of cheese.
